Worcester Superior Court - 1st Degree Murder trial. Defendant acquitted. The defendant was charged with first degree murder by shooting the alleged victim with a firearm. The defendant was also shot by the alleged victim during an altercation. After trial, the defendant was acquitted. The expert forensic evidence in the case from firearms experts demonstrated that the alleged victim shot the defendant first, and the defendant only returned fire in self-defense.

Worcester Superior Court - Child Rape trial. The defendant was charged with rape of the seven year old daughter of his girlfriend. The defendant was acquitted at trial. The evidence demonstrated that the defendant had an excellent relationship with the mother and child while he was living with them, and the charges only came to light months after the defendant and mother had a falling out and their relationship ended.

Worcester Superior Court - Armed Robbery trial. The defendant was acquitted at trial of armed robbery. Cross-examination of the alleged victim demonstrated that the physical evidence did not support the victim's description of how the assault and robbery occurred.

Worcester Superior Court - Assault and battery of a child causing serious, permanent injury. Defendant acquitted after trial of charge of assault and battery of a child causing serious, permanent injury. The defendant was convicted of the lesser included charge of assault and battery on a child causing injury. The defendant was accused of breaking the ribs of his one month old daughter by squeezing her. The child's mother was also accused. The mother fled the jurisdiction before trial; the defendant was tried alone.

Expert testimony at trial demonstrated that the rib fractures were not detectable by visual examination, nor had they been detected during routine visits to the child's pediatrician. The defendant accompanied the new born to the pediatrician for well baby visits before any injury was discovered. Expert testimony also demonstrated that the rib fractures healed completely and the child had no permanent injuries. The defendant received a significantly lower jail sentence than he would have had he been convicted of the most serious charges.

Worcester Superior Court - Home improvement suit. Clients sued improvement contractor for failure to properly remodel their home and build an addition. An expert witness was retained who was prepared to testify that the renovations done did not comply with the building code, and the addition was unsafe. On the verge of trial, a settlement was reached, after which the client was able to pay for the necessary repairs to be done by a different contractor.

Worcester Probate Court - Divorce.
Parties had a long-term marriage and owned a successful business together. Wife sued the husband (our client) for divorce,alleging cruel and abusive treatment and seeking the business and the major portion of the marital estate. She also took out a a civil restraining order against him.

After hearing, the court refused to extend the restraining order. After extensive litigation, including depositions and expert analysis by accountants, a settlement was reached under which the husband received the business and a divorce was granted on grounds of irreconcilable differences.

Worcester Superior Court - Hit and Run accident. We recently settled an automobile accident involving a hit and run driver for the limits of the insurance policy. The victim was a nine-year old girl. Her parents tried for more than three years to settle the claim. Although the statute of limitations for these claims is normally only three years, we were able to file suit and pursue a recovery because the victim was a minor. This case demonstrates the importance of consulting with an attorney soon after any accident, to insure that your rights are protected.

GREENFIELD - The Rev. Brion Ares of Athol was found not guilty of rape yesterday in Franklin County Superior Court.

But the jury remained deadlocked on a charge of indecent assault and battery. The 12 jurors will try again this morning at 9 to reach a verdict on that lesser charge.
